South African Ad Rules Accused of Overreach

South Africa’s gaming regulators have unveiled new advertising rules which seek to fill gaps left by the 2004 Gambling Act, but with new primary legislation mired in delay legal observers argue the new regulations amount to a backdoor prohibition on online gambling.

South African regulators recently moved to tighten elements of the Gambling Act relating to advertising, inviting consultation on new draft rules (trade.pdf) published last month by minister for trade and industry Rob Davies.

Watchers of the South African gaming market, however, have raised doubts over sections of the draft law which appear to go beyond the objective of simply revising advertising regulations to exclude online operators.
