U.S. Justice Department Reverses Wire Act Opinion, Invites Legal Challenge

The U.S. Department of Justice (DOJ) on Monday reversed its historic 2011 opinion that opened the door for states to legalize internet gambling, and the change is likely to create an uncertain future for the industry.

In a November 2, 2018 “slip opinion” published late Monday on the website of the Department of Justice’s Office of Legal Counsel (OLC), the OLC declared the 1961 Wire Act prohibits not only the interstate transmission of sports bets but also casino, lottery games and all other forms of online gambling.
