While some New York legislators continue to lobby for mobile sports betting to be legalized in the state, an ongoing court battle over the legality of daily fantasy sports could provide a preview of what may follow if efforts are successful.
Earlier this month, the appellate division of New York’s Supreme Court upheld a 2018 ruling that struck down a 2016 law that permitted daily fantasy sports to operate in the state by defining it as a game of skill rather than a game of chance.
Any expansion of gambling in the state requires a constitutional amendment, but legislators circumvented that in the 2016 law by defining daily fantasy as such.
