With its ambiguous ownership status under scrutiny from the European Commission, the Rhineland-Palatinate lottery seems headed for state ownership despite bidding interest from private operator Fluxx AG.
As part of its Detailed Opinion on the 2006 draft Interstate Lotteries Treaty, the European Commission noted inconsistencies in the fact that the Treaty would maintain state lottery monopolies whilst the lottery in Rhineland-Palatinate remains under private ownership by three local sports associations.
The lottery companies in all the other 15 German Lander are state-owned. According to the Commission, it may not be permissible under EC law for the lottery to remain in private hands whilst other private companies are denied the right to enter a tendering process.
