Online gambling affiliates typically flout data protection laws by not asking questions about the customer lists that they buy, one marketer has said.
“They don’t care what they get, they just start firing emails at [potential players],” said Jonathan Caruana, chief executive of SMSwarriors, a Malta-based marketing firm.
But ignorance of the law is no excuse, and responsibility cannot be shoved off on another party, according to the UK Information Commissioner’s Office (ICO).
“Companies must comply with the law when using people’s personal information,” said David Clancy, the office’s anti-spam investigations manager.
”Not knowing the law or trying to pass the buck to another company in the chain is no excuse.”
