Constitutional Questions Remain With New York’s DFS Law

A lawsuit filed by anti-gambling advocates in New York could eliminate daily fantasy sports (DFS) for at least two years if a judge rules the governor and lawmakers overstepped their authority when legalizing the popular games.

Stop Predatory Gambling, which raised money to fund the case, filed the lawsuit on behalf of four New York residents claiming DFS does fall within the state constitution’s broad prohibition against commercial betting, making it illegal in New York.

Horseracing, charitable gaming, commercial and tribal casinos and a state-operated lottery are legal in New York.
